網上購物條款及細則
1. 一般條款
1.1. 在本網上購物條款及細則及Microworks ACG Online Store特別條款(定義見下)(統稱「本條款及細則」)中,「Microworks」或「我們」是指Microworks ACG Limited 動漫聯動有限公司及Microworks ACG Online Store,而「客戶」或「您」是指任何在我們訂購貨品或服務的個人、機構或公司。請在使用本網頁(統稱「網店」)之前仔細閱讀本條款及細則。閣下使用網店或其中任何部分,即表示同意閣下已閱讀本條款及細則,並且接受和同意受本條款及細則所約束。
1.2. 我們會盡一切努力確保網店上所列載的貨品價格、產品資料正確。我們保留權利可更改貨品的價格而不作另行通知。我們可根據存貨供應,全權決定是否接受所有訂購。
1.3. 所有訂單須視乎相關貨品的供應情況再作最後確認。倘若我們未能提供任何已訂購之產品或服務,我們有權拒絕接受及取消該訂單。
2. 用戶登記
2.1. 您須(在網上或以其他方式)進行登記成為我們的用戶,方可於網店訂購貨品或服務。在登記時,即代表您承諾:
- 按要求提供有關您個人的真實、準確、最新及完整的資料;
- 您須確保妥善保存您的用戶名稱及密碼;
- 只有您或您授權的人士使用閣下的用戶名稱及密碼登入Microworks ACG Online Store;
- 我們有絕對酌情權拒絕任何新用戶之申請及終止任何已登記之用戶,而無須提供任何理由。
- 一經登記,即表示閣下同意聲明(而我們有權據此依賴有關聲明)閣下年滿18歲或以上,並有構成具法律約束力合約的能力。
2.2. 如您已登記的資料有任何更改,您可登入您的賬戶更新或以電話或電郵通知Microworks ACG Online Store客戶服務部,以確保我們能夠將最新的資訊帶給閣下。
3. 保障私隱
為致力保障您的個人資料的私隱權利,我們確保在收集、使用、保留、轉移及查閱個人資料方面的政策及常規,均符合香港法例第486章個人資料(私隱)條例的規定。請查看我們的私隱政策聲明。
4. 付款方式
4.1. 網店接受我們所指定的電子支付方式付款,所有貨品之價值均以港幣計算。網店的貨品價格有可能與我們的經銷商店鋪有所出入,貨品以訂購當日網店所示之價格為準。
4.2. 所有網上訂購的貨品須由我們全權決定並根據存貨供應而接受。閣下將於收取貨品(於送貨或自取)時收到最終的購物收據以作記錄。
4.3. 為提供安全可靠的網上購物服務,網店的交易使用安全接層加密技術 Transport Layer Security (TLS)。所有個人資料包括您的信用卡號碼、姓名、地址等,會經過電子付款平台加密,才透過互聯網傳送,防止您的資料在網上傳送時,被未經許可的第三者閱讀。如要檢查安全憑證的資料,您可於結賬時按滑鼠右鍵,然後選擇「內容」及「憑證」。
5. 訂購須知
5.1. 網店只接受在香港及澳門的指定送貨的帳單地址,或客戶服務中心自行取貨的訂單。
5.2. 您向我們訂購產品時,即表示您同意按照本條款及細則向我們提出購物請求。收到您的訂單之後,我們將通知您並確認收到該訂單。該回覆並不代表我們已經接受您的訂單。倘若我們未能提供任何已訂購之產品或服務,或因您所使用的信用卡導致之付款問題或任何其他原因,我們有權拒絕接受該訂單。倘若我們無法提供閣下訂單上的任何產品或服務,我們會透過電話或電郵通知閣下。
※ 提醒您,訂單未結帳前,並無保留商品庫存功能,商品庫存分配將以確認結帳順序為依據。如以銀行轉帳方式結帳, 請於確認訂購時間起24小時內完成結帳, 否則系統將自動取消該訂單而不作另行通知。
5.3. 閣下的訂購請求獲我們接受後,我們會與您確認接受訂單,並同時通知您送貨 / 在客戶服務中心自行取貨的時間和日期。
5.4. 如您所訂購貨品所附送之贈品已經送完,我們將會通知您有關情況。閣下有權接受我們建議之另一贈品、選擇取消訂單或繼續購買該產品。
5.5 供貨的基礎:我們僅向香港及澳門最終消費者銷售和運送產品。客戶於Microworks ACG Online Store之商品不可用作轉售用途。如果我們有合理的依據認為您購買我們的產品並作為轉售之用途,我們有權拒絕或取消您的訂單。
6. 送貨服務(適用於選擇將訂單送往指定的送貨地址)
6.1. 每次於網店購物金額滿港幣300元或以上,您可免費享用順豐速運送貨服務。
6.2. 香港送貨服務範圍由順豐速運送貨,只限香港、九龍、新界、部分離島地區。詳情可到以下網址查詢http://www.sf-express.com/hk/tc/dynamic_function/range/。收貨人須先與我們查詢有關送貨服務安排之詳情。
6.3. 送貨服務不適用於非工商區固定地址、邊境禁區、離島、貨倉、強制檢測指明場所、隔離酒店或設施、不能經樓梯送貨而需經由露台入屋之地點。
6.4. 當您於網店提交訂單後,如訂單獲我們接受,我們將會與您確認預計送貨時間及日期。貨物抵達前將由送貨員致電通知,請您點收訂購了的貨品是否齊全,並由收件人在送貨單上寫上姓名及簽名確認收取貨品。
6.5. 若懸掛八號颱風訊號或黑色暴雨警告,我們將盡力安排下一個工作天送貨。
6.6. 如果您因在首次約定的送貨預約時失約或因您提供不準確地址而導致您未能收取您訂購的產品,我們會(i)就其後的送貨預約保留向您收取額外送貨費用的權利或(ii)安排您到我們的客戶服務中心直接取貨。
6.7. 所有送貨日期和時間均為預計送貨日期和時間。就您可能因為送貨延誤所可能造成的損失或損害,Microworks 恕不負任何責任。
6.8. 當訂單確認後超過30天仍未收取貨品,我們有權取消該訂單及交易而毋須另行通知。在此情況下,我們不會向您退款,亦保留向您索取存儲費用的權利。
6.9. 如有任何爭議,我們保留最終的決定權。
6.10. 順豐速運是本公司默認委託的送遞營辦商。本公司可能就不同情況委託其他的送遞營辦商或採用其他的送貨方式。
7. 客戶服務中心自取服務(適用於已經選擇在客戶服務中心自行收取之訂單)
7.1. 當您訂購的產品已準備好可供收取時,我們會通過手機短信或電子郵件通知您。
7.2. 請您於10日內於營業時間期間前往收取已購買之產品。
7.3. 當您在客戶服務中心領取產品時,您或您的授權代表須向我們展示在確認您的訂單之電子郵件或手機短信,以進行身份驗證。我們可能需要您提供進一步的資料來驗證您的身份(例如您的全名或您的帳戶下的其他個人資料)。如果我們不能證實要求收取貨品的人是您本人或您的授權代表,我們將拒絕該人士收取您的訂單,以保障您的利益。
7.4. 訂單一經確認,我們不會再更改您所選定了之送貨地點。
7.5. 如您選擇客戶服務中心因天氣及其他因素影響下而停止營業,您可於翌日前往領取產品。
8. 換貨及退款
8.1. 如發現購買之商品有損壞/有缺陷;或不是你訂購的商品,你可以在收到商品後7天內聯繫我們的客戶服務中心要求更換或退款。(*退換政策不適用於「Figure/公仔/人偶/景品」類產品,詳情請閱第8.10項)
8.2. 當收取貨品時,請立即檢查所訂購之貨品及配件是否齊全或存有損毀及缺陷。若發現所訂購之產品出現問以上問題,請拍照紀錄有關問題,並於購買日後7天內與我們聯絡。Microworks會有專人為您跟進及安排退換。
8.3. 當我們確認更換貨品,但所要求更換之貨品已經售罄,我們會以你購買商品時付款的方式退款給你。
8.4. 如需要退款到您的信用卡或PAYPAL帳戶,退款時間需時大約7至30天,視乎發卡銀行而定。
8.5. 更換之貨品必須連同完整包裝、配件、說明書及保用証一併退回。
8.6. 更換或退貨並不包括因人為而損壞之貨品。
8.7. 貨品必須與所有購買時所附送之贈品一併退還,否則我們將從退款中扣除該贈品的價值。
8.8. 除了貨品在收貨時有損壞/有缺陷外,我們不接受改變心意而退貨的要求。
8.9. 貼身衣物或襪子基於個人衛生及安全問題不能要求更換或退貨。
8.10. 退換政策不適用於「Figure/公仔/人偶/景品」類產品。任何缺件/錯件/損壞或塗裝問題情況,貴客須自行向代理商申請換件/補件,審批均以該代理商既定程序及準則為依歸,審批結果將由代理商作最終決定。有關產品代理商聯絡資料方法,可聯絡本公司查詢。
9. 免責聲明
9.1. 無論在任何情況下,您因與我們之間的交易而引致任何收入損失(不論直接或間接)、利潤或任何間接或後遺損失,我們概不負責。
9.2. 不可抗力:我們倘若由於不可抗力的原因(包括由於天災、火災、水災、意外、暴亂、戰爭、政府政策、禁運、罷工、勞動困難、設備故障或任何我們不能控制的情況)而未能準確地提供閣下所需的產品或服務,我們均不會向使用者或任何第三者承擔任何責任。
9.3. 未得我們發出書面同意之前,您不可將本條款及細則的任何權利及責任以分配、轉送或任何其他形式轉讓給任何其他人等。
9.4. 若本條款及細則其中任何條款被解釋為非法或無效,該等條款將被删除及不影響本條款及細則其他條款的合法性、有效性及可執行性。
9.5. 本條款及細則包含了雙方的全部協議,其亦取替所有之前之商議、聲言、共識及協議。
9.6. 我們保留一切權利,可於任何時間及不時更改本條款及細則,而無需作出通知。
9.7. 如有任何爭議,我們保留最終的決定權。本條款及細則的中文譯本僅供參考之用,倘若中、英文本之文義有異,應以中文原文為準。
9.8. 本條款及細則將按照中華人民共和國香港特別行政區法律詮釋,而你及我們同樣受香港法院所管轄。我們可能不時對本條款及細則作出更正修改而不向您作預先通知。
10. 私隱政策
Microworks ACG Limited 動漫聯動有限公司 (下稱 “我們”)承諾遵守「個人資訊(私隱)條例」的有關規, 並妥善處理閣下向我們提供的個人資料。
資料的收集和目的
我們將可能要求閣下透過本網站提供姓名、電話及其他方式按自願性原則提供某些個人資料。該等個人資料只限用於以下之目的, 包括:訂單聯絡、保養服務、維修跟進、技術支援、回應產品資訊查詢及投訴、商業活動、產品活動推廣等。 於閣下提供個人資料前,我們將表明身份並詳述有關目的。閣下的個人資料將於該目的完成後自動刪除。

1. General Terms
1.1. In these Terms and Conditions for Online Shopping and Special Terms and Conditions for Microworks ACG Online Store (as defined below) (collectively referred to as the "Terms and Conditions"), "Microworks" or "we" refers to Microworks ACG Limited. Company and Microworks ACG Online Store, and "customer", "user" or "you" refers to any individual, organization or company that orders goods or services from us. Please read these terms and conditions carefully before using this website (collectively referred to as the "Online Shop"). By using the online store or any part of it, you agree that you have read these terms and conditions, and accept and agree to be bound by these terms and conditions.
1.2. We will make every effort to ensure that prices and products information listed on the online store are correct. We reserve the right to change the price of the goods without prior notice. We reserve the right to decide whether accepting the orders based on the inventory supply.
1.3. All orders are subject to final confirmation based on the availability of relevant goods. If we fail to provide any ordered products or services, we have the right to refuse to accept and cancel the order.
2. Registration
2.1. You are required to register a customer account (online or by other means) before you make the purchase of goods or services in the online store. During the registration:
- You must provide true, accurate, up-to-date and complete information as required;
- You must ensure that your user name and password is safeguard;
- Only you or a person under your authorization can log in to Microworks ACG Online Store with your user name and password;
- We have the absolute discretion to reject and terminate any new customers and any registered customers for any reason whatsoever.
- By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.
2.2. If there are any changes or update regarding to your registered information, you can log in to your account updating or notify Microworks ACG Online Store Customer Service Center by phone or email in order to bring you any latest information.
3. Privacy Protection
In order to protect the privacy rights of your personal data, we ensure that our policies and practices regarding the collection, use, retention, transfer and access of personal data comply with the provisions of the Personal Data (Privacy) Ordinance, Chapter 486 of the Laws of Hong Kong. Please refer to our privacy policy statement.
4. Payment Method
4.1. The online shop accepts specified electronic payment methods and products and/or services are listed in Hong Kong dollars. The price of the products listed in the online store may differ from the price of the products in our dealers. The applicable price of a product shall be the price listed in our online store as at the date of purchase.
4.2. All goods ordered online must be determined and accepted based on inventory availability by us at our sole discretion. Final purchase receipt will be given when you receive the goods (in delivery or self-pickup).
4.3. In order to provide safe and reliable online shopping experience, transactions in online stores use Transport Layer Security (TLS). All personal data, including your credit card number, name, address, etc., will be encrypted by the electronic payment platform before being transmitted over the Internet to prevent your data from being read by unauthorized third parties when it is transmitted online. If you want to check the security certificate information, you can right-click the mouse during checkout and select "Properties" and "Certificate".
5. Ordering Instructions
5.1. The online shop only accepts the designated delivery billing address in Hong Kong and Macau, or the order is self-picking up from our Customer Service Center.
5.2. By using this website of requesting, making the purchase and placing the order to us, means you represent that you have read, understood and agreed the terms and conditions stated herein and that you agree to be bound by them. After receiving your order from our online platform, notification of order received will be noticed to you. This reply does not mean that the order has been accepted. We reserve the right to reject any purchase order without giving any reasons. If we are not able to proceed with any ordered products or services, or payment problems caused by the credit card/bank you are using or any other reason, we have the right to refuse the acceptance of the order and we will notify you by phone or email.
※ Remind you that the ordering platform does not reserve merchandise inventory before the order payment is successfully settled. The merchandise inventory allocation will be based on the complete payment sequence. If you make the payment by bank transfer, please settle the payment within 24 hours from the time the order is entered, otherwise the ordering platform will automatically cancel the order without any notice.
5.3. If you order is accepted by us, we will confirm with you accordingly by email/SMS/phone call to you on the merchandises to be delivered or to be picked-up at our customer service center.. Once the order has been accepted and confirmed, the delivery address shall no longer be changed.
5.4. If there is a bundle gift item included with you ordered and that bundle gift item is out of stock, we will notify you of this situation. You have the right to accept another bundle gift suggested by us, choose to cancel the order or continue to proceed with the order.
5.5 Basis of supply: We sell and ship products to end customers in Hong Kong and Macau regions and purchases of goods are used for personal purpose only and resale is prohibited. If there is a reasonable basis to believe that you purchased our products are used for resale purposes, we have the right to refuse or cancel your order.
6. Delivery Service (applicable to choose delivery service to the designated delivery address)
6.1. For each total purchase order of HKD$300 or more in our online store, you entitle to enjoy free SF Express delivery service.
6.2. We appoint SF Express to handle the delivery service in Hong Kong and Macau regions. Destinations of delivery service are subject to SF Express. If you have any inquiries regarding the delivery district, please feel free to check with our customer service center before placing an order. The consignee must first check with us about the details of the delivery service arrangement.
6.3. The delivery service is not applicable to restricted areas, warehouses, compulsory quarantine building/district and designated quarantine hotel, and places that cannot be delivered via stairs but need to reach the destination via the terrace.
6.4. After you submit the order in the online store, we will confirm the estimated delivery time and date with you if the order is accepted by us. Before the arrival of the goods, the delivery person will contact to notify you. Please check whether the ordered goods content are all correct, and the recipient needs to sign on the delivery note to confirm and complete the receipt of the goods.
6.5. Black rainstorm warning, typhoon signal No. 8 or above, Severe flooding, blocked or closed roads due to weather condition, building that is under the compulsory testing list. The delivery service will be suspended and the delivery schedule will be arranged accordingly.
6.6. If the Goods delivered by the Company are not received due to refusal of receipt, provided an inaccurate address, or other reasons attributable the customer, we will
- Charge you the additional delivery cost for arranging the same purchase order delivery again or
- Pick up the goods directly from our customer service center without paying back the delivery charge which was charged from purchase order.
6.7. All delivery dates and times are under estimation only. Delivery may be delayed due to various circumstances such as item(s) is/are being out of stock or Microworks is-are being unable to respond to the order. Even in these cases, Microworks will not be held liable for any loss or/and damages. Microworks will also not be held liable for delay or cancellation of delivery that you may cause not attributable to the Company.
6.8. If the delivery company designated by Microworks returns the goods to Microworks for the reasons mentioned in paragraph 6.6 of this Article, we will notify you thereof as soon as practicably possible. If we cannot contact you or has not received a reply from you within thirty (30) days after purchase invoice date, it will be deemed that you have abandoned the goods to be delivered / collected. We reserve the right to cancel the order and transaction without prior notice. In this case, refund will not be made to you and we reserve the right to ask you for storage charge.
6.9. In case of any dispute, we reserve the right of final decision.
6.10. We appoint SF Express as our delivery service operator by default. We may make the arrangement of entrusting other delivery service operator or using other delivery methods depending upon different situations.
7. Customer Service Center Self-pickup Service (applicable to orders that have chosen as “collect” at our customer service center)
7.1. When the product you ordered is ready for collection, we will notify you via SMS or email.
7.2. Please collect the purchased products during business hours within 10 days.
7.3. When you pick up the product at our customer service center, you or your authorized representative must show us the email or mobile phone message of ordered details as a proof confirming your order for identity verification. We may need you to provide further information to verify your identity (such as your full name or other personal information under your registered account). If we cannot verify that the person requesting the goods is you or your authorized representative, we will refuse the person collecting your order in order to protect your interests.
7.4. Once the order is confirmed and delivery is arranged, we will not change the delivery location you have selected.
7.5. If our customer service center is under suspension due to weather condition or other situation, you can pick up the products on the next day.
8. Exchange and Refund
8.1. If the purchased product is damaged / defective, or is not the product that you ordered, you can contact our customer service center to apply for a replacement or refund within 7 days after receiving the product. Or send the wrong shipped product back to us at our expense. We’ll only count a return request as damaged / defective. (*The Exchange and Refund policy does not apply to "Figure" series products, please refer to item 8.10 for details.)
8.2. When receiving the goods, please check the contents immediately whether the ordered goods and accessories are complete and correct. If you find that the product you ordered has the above problems in paragraph 8.1 of this Article, please take a photo and contact us within 7 days after the purchase date. Microworks will follow up and arrange the return for you.
8.3. When we confirm the replacement of that item, but the requested replacement item has been sold out, we will refund you from the payment method you purchased the goods.
8.4. If a refund is required back to your credit card or PAYPAL account, the money back procedure takes about 7 to 30 days to process, depending on the issuing bank.
8.5. The replacement product must be returned together with the complete package, accessories, manual and warranty card.
8.6. Physical damage of the goods cannot be claimed as replacement or return.
8.7. The goods must be returned together with all the gifts (if any) that was included with the purchase, otherwise we will deduct the value of the gifts from the refund.
8.8. Change your mind about a purchase is not entitled to a refund or exchange.
8.9. Personal hygiene related items such as underwear; socks and clothing cannot be replaced or returned.
8.10. The return/refund policy is not applicable to "Figure" series products. For any missing/wrong/damaged/painting problem parts and/or items, you should apply for replacement/replacement approval from its distributor/supplier on your own. All these replacement requests and approvals are based on the distributor/supplier established procedures and criteria, and the final decision will be made by the distributor/supplier. Please contact us for the contact information of the distributor/supplier of the product.
9. Disclaimer
9.1. We will not be responsible for any damage, loss(whether direct or indirect), profit, any indirect, subsequent loss or claim arising from the use of Microworks ACG Online Store under any circumstances, regardless of the causes of such legal claims. In addition, we will not be responsible for any damage, loss, or claim arising from the goods sold and purchased using Microworks ACG Online Store.
9.2. Force majeure: if we cannot be accurate due to force majeure (including due to natural disasters, fires, floods, accidents, riots, wars, government policies, embargoes, strikes, labor difficulties, equipment failures or any situation beyond our control), to provide the products or services you need, we will not assume any responsibility to the customers or any third parties.
9.3. You may not assign, transfer or transfer any rights and responsibilities of these terms and conditions to any other person in any other form without our written consent.
9.4. If any clause of these terms and conditions is interpreted as illegal or invalid, those terms will be deleted and will not affect the legality, validity and enforce-ability of other terms of these terms and conditions.
9.5. These terms and conditions contain all the agreements between the two parties, which also replace all previous discussions, statements, consensus and agreements.
9.6. We reserve all our rights, from time to time, to amend the Terms and Conditions hereof without giving further notice to you..
9.7. In case of any dispute, we reserve the right of final decision. The Chinese translation of these terms and conditions is for reference only. If the meanings of the Chinese and English versions are different, the Chinese original text shall prevail.
9.8. These terms and conditions will be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, and you and we are also subject to the jurisdiction of the Hong Kong courts. We may make corrections to these terms and conditions from time to time without prior notice to you.
10. Privacy Policy
Microworks ACG Limited (hereinafter referred to as "we") is committed to abide by the relevant regulations of the "Personal Information (Privacy) Ordinance" and to properly handle the personal data you provide to us.
11. Data Collection and Purpose
11.1. We may ask you to provide certain personal information on a voluntary basis through this website by providing your name, phone number and other methods. Such personal data is only used for the following purposes, including: order contact, maintenance services, repair follow-up, technical support, response to product information inquiries and complaints, commercial activities, product promotion, etc. Before you provide your personal information, we will identify yourself and detail the purpose. Your personal data will be automatically deleted after the purpose is completed.
11.2. We take the security of your personal data very seriously. We have adopted administrative management and technical security measures to prevent others from accessing, damaging or modifying your information without authorization. Despite our best efforts, no security measures are foolproof.
11.3. We reserve the right to revise, change or modify this privacy policy statement without prior notice.
12. Intellectual Property
The content in Microworks ACG Online Store is our intellectual property and is protected, or we obtain authorization from the relevant product and information supplier or its owner. The rights to copyrights, brand trademarks, product photos/images, service marks, patent rights or other proprietary rights belong to us or the relevant product and information suppliers or their owners. You may not modify, reprint or distribute all or part of its content. Regarding the content of this website, you have no right not to use any of its content unless permitted by these terms.
